In accordance with Rules 7.2, 7.3, 22 and 24.5 of the Rules Governing the Withdrawal of Groundwater in Water Division No. 3 (the Rio Grande Basin) and Establishing Criteria for the Beginning and End of the Irrigation Season in Water Division No. 3 for All Irrigation Water Rights, on May 22, 2025 the State Engineer provided notice of updated Response Functions based upon the RGDSS Phase 7 model to Well Users withdrawing groundwater pursuant to plans specified in Rule 6.1 for use in Well Users’ 2026 plans. Rule 20.2 of those rules provides that a “Person adversely affected or aggrieved by the State Engineer’s or Division Engineer’s decision may file a request for an adjudicatory hearing under 2 CCR 402-5 provided the request is filed by the end of the month following the month in which the State Engineer gave notice of the decision to the Person.” Although the time to request a hearing on the updated Response Functions has passed, the State Engineer is extending the time to request an adjudicatory hearing on this issue through the end of the day on August 19, 2025. This request should contain the information required in the Division of Water Resources Procedural Regulations 2 CCR 402-5, Rule 10.B.4.
